Moving Terms & Conditions.

Welcome to Easy as™. We are pleased that you are considering our services for your move or relocation. Trusting your belongings to others is an important decision, and we want you to feel secure, confident and well-informed.

This document sets out the terms that govern our relationship. We have drafted them clearly and transparently, seeking to protect both your interests and ours.

By requesting a quote, paying a deposit, or contracting our services, we understand that you have read and accepted these terms.

1. Acceptance of terms.

By accessing our services, requesting a quote, making a payment, or contracting a move, you (the Client) agree to be bound by these Terms and Conditions.

These terms constitute a legally binding agreement between you and Teal Innovations Limited trading as Easy as™.

2. Quotes and pricing.

Our quotes are prepared carefully, based on current rates at the time of issue, including labour, freight, fuel, port charges, and other identifiable costs.

The transport sector is subject to fluctuations. If rates change before or during your move for reasons beyond our control, we may need to adjust the final price. In such cases, we will communicate the changes transparently before proceeding.

Quotes are valid for [30] days from issue, unless a different period is indicated.

3. Deposit and payment.

To confirm your booking, a non-refundable deposit of 50% of the quote amount is required. This deposit secures the date and allocates the necessary resources exclusively for your move.

The remaining 50% is paid on the day of collection of your goods, after verifying and measuring the items. In this way, you pay only for what is actually transported.

Payments are processed through authorised payment processors that comply with PCI DSS security standards. Easy as™ does not store complete credit card data or sensitive financial information.

Late payments may be subject to interest, which will be advised accordingly.

4. Client responsibility regarding property and goods.

The Client declares and agrees that:

4.1 Property access: We may safely access the property at the origin and destination for collection and delivery. The Client is responsible for obtaining necessary permits (parking, loading/unloading, etc.) and ensuring adequate access conditions.

4.2 Ownership of goods: The goods to be transported are your property, or you have the necessary legal authority to do so. In the event of third-party claims regarding ownership of the goods, the Client shall assume all resulting costs.

4.3 Adequate dimensions: The Client confirms that furniture and boxes can pass through doors, stairways, lifts, and hallways without difficulty. If there are items of exceptional dimensions, you must inform us in advance.

4.4 Preparation for the move: On moving day, the Client must verify that no important items are left behind, protect valuables that are not part of the move, and be present (or designate an authorized person) during loading and unloading.

Any additional costs arising from failure to meet these responsibilities shall be borne by the Client.

5. Prohibited or dangerous items.

We cannot transport, under any circumstances, the following items:

  • Flammable materials (fuels, paints, solvents, aerosols).
  • Explosives (ammunition, fireworks, gunpowder).
  • Corrosive or toxic materials.
  • Perishable items (fresh food, plants, flowers).
  • Illegal items or those prohibited by transport regulations.
  • Cash, undeclared high-value jewellery, unique historical documents.

If such items are detected during the move, we will contact the Client to agree on the procedure to follow.

Costs of removal, disposal, or special handling shall be borne by the Client. Easy as™ assumes no responsibility for loss or damage to such items if they have not been properly declared.

6. Additional items.

If items not included in the original quote appear during the move, the Client may request their inclusion. Easy as™ will advise of additional costs according to current rates and will proceed only with the Client's express approval.

7. Acting on the Client's behalf.

In unforeseen situations requiring decisions to protect goods during the move, Easy as™ may act on the Client's behalf. Any reasonable costs incurred through such actions will be communicated to the Client and added to their account.

8. Liability for damage (without insurance).

Unless the Client contracts transit insurance in writing and pays the corresponding premium before the move commences, the goods will travel at the owner's risk ("Owner's Risk").

Under this arrangement, the liability of Easy as™ and external carriers is strictly limited as described in Clauses 17 and 19 of this agreement.

9. Cargo insurance (recommendation).

Given that the legal liability of carriers is limited (as detailed in Clause 15), Easy as™ expressly recommends contracting comprehensive transit insurance.

This coverage constitutes the only effective protection for your belongings against the risks inherent in international and domestic transport.

10. Insurance contractation.

Insurance must be requested in writing at the time of accepting the quote. Easy as™ will provide the Client with the insurance proposal for review and signature.

The insurance premium will be incorporated into the final payment for the move.

Contracting insurance implies acceptance of the terms and conditions of the insurer's policy.

11. Insurance conditions.

Insurance coverage is subject to the terms, conditions, limits, and exclusions established in the insurer's policy (including, as applicable, Ando Insurance Group Limited or other providers).

The full policy is available and may be requested directly.

If goods are deposited in a warehouse for any period, standard transit insurance coverage automatically ends upon entry to the warehouse.

For the storage period, specific insurance is required, which Easy as™ can assist in arranging.

12. Accuracy of information provided.

All quotes and service arrangements are based on the information provided by the Client at the time of booking.

If the information provided is inaccurate, incomplete, or changes before collection takes place, Easy as™ reserves the right to revise the quotation and apply additional charges where necessary.

13. Cancellation or changes to booking.

Once a moving service has been confirmed and scheduled, Easy as™ begins allocating resources, booking transport, and planning logistics for the shipment.

If the Client cancels the move after the booking has been confirmed, the initial deposit remains non-refundable, as outlined in the Payment section.

If cancellation occurs within 48 hours of the scheduled collection date, Easy as™ reserves the right to charge reasonable costs already incurred in preparation for the move, including labour scheduling, transport arrangements, or third-party booking fees.

If the Client requests changes to the scheduled collection or delivery dates, Easy as™ will make reasonable efforts to accommodate those changes; however, additional charges may apply depending on availability, logistics adjustments, and costs incurred.

14. Insurance policy details.

Comprehensive transit insurance coverage includes, in accordance with the policy terms:

  • Total or partial loss of insured goods.
  • Accidental damage during transport.
  • Fire, collision, or overturning of the transport vehicle.
  • Theft with force.
  • Certain water damage during transit.

Principal exclusions include, among others:

  • Normal wear and tear, gradual deterioration, or inherent vice of goods.
  • Loss or damage due to a delay in delivery.
  • Damage arising from inadequate packing, especially when the Client has done the packing.
  • Items specifically excluded in the policy.

15. Practical access conditions.

15.1 Equipment access: The quote assumes that Easy as™ trucks and equipment can access the collection and delivery address without difficulty. If there are uncommunicated restrictions, additional charges may apply.

15.2 Buildings and stairways: The quote assumes that doors, stairways, and hallways have sufficient dimensions for furniture and boxes to pass through. Otherwise, special equipment or alternative procedures with additional cost may be required.

15.3 Driveways and paths: Easy as™ shall not be liable for damage to driveways, paths, or accessways unless the Client has specifically instructed in writing not to use them.

16. What is not included in the quote.

The following are not included in the quote, unless expressly agreed in writing:

  • Customs duties, taxes, consular or municipal fees.
  • Fines or administrative penalties.
  • Cargo insurance premiums.
  • Unforeseen storage costs.
  • Dismantling or installation of fixtures (lamps, appliances, blinds, antennas, carpets).
  • Cleaning, pest control, or special treatment services.

If the Client requires these services, Easy as™ may provide them at additional costs previously agreed.

Easy as™ will exercise reasonable care in handling and arranging the transport of goods. However, to the fullest extent permitted by law, Easy as™ will not be liable for any indirect loss, consequential loss, loss of profits, loss of use, or any financial loss arising from delay, damage, or loss of goods during the provision of services.

17. Carriage at owner's risk.

In accordance with Section 248 of the Contract and Commercial Law Act 2017 of New Zealand, the Client acknowledges and agrees that goods transported by external carriers contracted by Easy as™ (including, among others shipping lines, airlines, and land transport carriers) may be, and usually are, transported under the "Owner's Risk" regime.

17.1 Definition: "Carriage at owner's risk" means that the carrier's liability for loss or damage to goods is limited as follows:

  • The carrier is not liable for any loss or damage to goods during transport.
  • The only exception occurs when the loss or damage is intentionally caused by the carrier, an exceptional circumstance, and is difficult to prove.

17.2 Easy as™ position: Easy as™ acts as a freight forwarder and intermediary, not as a carrier. Consequently, Easy as™ shall not be liable for losses or damages arising from carriage at the owner's risk by external carriers.

17.3 Coverage recommendation: For effective protection, Easy as™ recommends contracting the offered transit insurance, the only way to obtain coverage against transport risks.

18. Our role (freight forwarder).

Easy as™ acts as a freight forwarder and logistics coordinator. Our function is to organize and supervise the various elements necessary for the move: loading and unloading teams, land carriers, shipping lines or airlines, customs agents, and warehouses.

Easy as™ does not act as a common carrier nor assume the responsibilities inherent to carriers. Our role is to coordinate carriers on behalf of the Client.

19. Limitation of liability.

In its capacity as freight forwarder, and to the maximum extent permitted by law, Easy as™ shall not be liable to the Client for:

19.1 Damages or losses subject to the liability limitation of external carriers pursuant to Clause 15.

19.2 Consequential, indirect, or punitive damages, including loss of profits, loss of use, replacement costs, alternative accommodation expenses, or any other economic loss arising from delays, damages, or losses.

19.3 Force majeure events: strikes, labour disputes, extreme weather conditions, natural disasters, acts of terrorism, war, epidemics, pandemics, border closures, government decisions, actions of customs authorities, or any other circumstance beyond the reasonable control of Easy as™.

The maximum liability of Easy as™, in any circumstance, shall not exceed the total amount paid by the Client for the services provided.

20. Carrier regulations.

The transport of goods is subject to the terms and conditions of the participating carriers (land, maritime, air), as well as applicable international conventions (including, as applicable, the Warsaw Convention for air transport or the Hague Rules for maritime transport). The Client accepts these conditions when contracting the service.

21. Working hours.

The quote is based on work being carried out during ordinary working hours (Monday to Friday, 8:00 am to 5:00 pm, excluding public holidays). If services are required outside these hours, or if delays attributable to the Client extend the working day, additional charges may apply.

22. Claims.

22.1 Prerequisite: All invoices must be paid in full before a valid claim can be submitted.

22.2 Visible damage: Any noticeable damage at the time of delivery must be recorded on the delivery document, this being the only valid means for subsequent claim.

22.3 Non-visible damage or partial loss: The Client shall have a period of 7 days from the delivery date to notify in writing of non-visible damage or partial loss, accompanied by a detailed description and photographic documentation.

22.4 Total loss: For cases of total loss of goods, the notification period shall be 30 days from the expected delivery date.

If these periods elapse without notification, the goods shall be deemed to have been delivered in conformity.

23. Delays in delivery and storage.

If goods arrive at the destination and cannot be delivered for reasons attributable to the Client (including absence, lack of destination preparation, refusal to receive the goods, or similar circumstances), Easy as™ may place the goods in a warehouse at the Client's cost and risk.

Placement of the goods in a warehouse shall be considered effective delivery for the purposes of this contract. From that moment, Easy as™ responsibility for the goods shall cease and applicable storage charges shall begin to apply.

Easy as™ will make reasonable efforts to notify the Client before arranging such storage.

If modifications to storage charges occur during the storage period of the goods, Easy as™ will notify the Client in writing and the updated charges will apply from the date of such notification.

Any delivery dates or transit times provided by Easy as™ are estimates only and are not guaranteed.

International shipping and logistics may be affected by factors outside the reasonable control of Easy as™, including customs inspections, port congestion, shipping line schedules, weather conditions, transport disruptions, or government actions. Easy as™ will not be liable for delays resulting from such circumstances.

24. Storage charges.

Applicable storage charges shall be those in effect at the time of the goods' entry into the warehouse. Such charges shall be paid in advance, within the periods established.

Interest on overdue amounts may apply, which will be communicated to the Client.

Easy as™ may modify storage charges, notifying the Client with sufficient advance notice.

25. Non-payment and sale of goods.

If amounts owed (for transport, storage, insurance, or any other concept) remain unpaid for a period exceeding 3 months, Easy as™, after prior written notice to the Client with 30 days' advance warning, may proceed with the sale of the goods at public or private auction to recover the debt.

The amount obtained shall be applied in the following order:

  1. Sale expenses.
  2. Client's outstanding debt, including interest, if any.
  3. Any surplus, if it exists, shall be made available to the Client.

26. Lien.

Easy as™ holds a general lien over all goods in its possession while there are amounts unpaid by the Client, regardless of the specific service to which they relate.

This right implies that goods may not be delivered until all debt has been satisfied. The lien extends to storage charges and other costs incurred during the retention period.

27. Changes in storage charges.

If modifications to storage charges occur during the storage period of the goods, Easy as™ will notify the Client in writing, and the new charges shall apply from such notification.

28. Notices.

All notices shall be sent to the last physical or electronic address provided by the Client. They shall be considered validly received:

  • By post: 7 days after sending.
  • By email: on the same day of sending.

It is the Client's responsibility to keep their contact details updated.

29. Delivery of goods.

Delivery of goods shall be made exclusively:

  • To the Client personally, upon proof of identity.
  • To a person expressly authorized by the Client in writing, presenting the corresponding authorization and identification document.

Delivery shall not proceed while there are outstanding amounts owed to Easy as™ under this agreement.

30. Changes to the contract.

No employee, agent, or representative of Easy as™ is authorized to modify, alter, or waive any of the provisions of these Terms and Conditions. Any modification must be made in writing and signed by a director of Teal Innovations Limited.

Website Terms of Use.

31. Use of the website.

The Easy as™ website is provided to facilitate information about our services and allow quote requests. The Client agrees to use the website lawfully and respectfully, refraining from:

  • Performing acts that may damage, overload, or impair the functioning of the site.
  • Attempting to access restricted areas of the site without authorization.
  • Using the site for illegal purposes or contrary to good faith.

32. Content and intellectual property.

All content on the Easy as™ website (including, without limitation, texts, graphics, logos, icons, images, audio, video, designs, and software) is the property of Easy as™ or its licensors and is protected by intellectual property laws.

The Client may view and download content for personal and informational use but may not reproduce, distribute, modify, or commercially exploit it without express written authorization from Easy as™.

The “Easy as™” brand and trade name Teal Innovations Limited are registered trademarks and may not be used without prior consent.

33. Online tools and estimates.

The website may include tools for estimating volume, time, or costs based on information provided by the Client. These tools offer indicative values and do not constitute a definitive quote.

The final price, exact measurements, and detailed planning will always be confirmed by the Easy as™ team before service formalization.

Easy as™ does not guarantee the absolute accuracy of estimates generated by these tools.

34. Links to third-party websites.

The Easy as™ website may contain links to third-party websites. These links are provided exclusively for the Client's convenience. Easy as™ does not control such websites, assumes no responsibility for their content, privacy policies, or practices, and this does not constitute endorsement or approval of them. Access to third-party websites is at the Client's sole responsibility.

35. Limitation of liability (website).

To the maximum extent permitted by law, Easy as™ shall not be liable for damages of any nature arising from access, use, or inability to use its website, or from reliance on the information contained therein. This limitation includes, without limitation, direct, indirect, incidental, consequential, or punitive damages.

36. Applicable law and updates.

36.1 Applicable law. These Terms and Conditions are governed by the laws of New Zealand. For any dispute that cannot be resolved amicably, the parties submit to the exclusive jurisdiction of the courts of New Zealand.

36.2 Updates. Easy as™ may modify these Terms and Conditions at any time, publishing the updated version on its website with an indication of the new effective date.

Continued use of Easy as™ services after such update shall imply acceptance of the new terms.

37. Entire agreement.

These Terms and Conditions, together with the quote accepted by the Client, the Privacy Policy, and any other document specifically signed for the move, constitute the entire agreement between the parties, superseding any prior communication, agreement, or understanding, whether verbal or written.

38. Contents of packed cartons.

Easy as™ is responsible for the external condition of cartons or packages that we pack. However, Easy as™ cannot be responsible for the internal condition of items packed within cartons where there is no visible damage to the carton itself.

If a carton, box, or package is delivered without visible external damage, it will be considered to have been transported in good condition.

Where cartons have been packed by the customer or a third party not arranged by Easy as™, Easy as™ cannot accept responsibility for the condition or protection of the contents inside those cartons.

Customers are encouraged to declare fragile items and request professional packing services to ensure adequate protection during transit.

39. Partial invalidity.

If any provision of these Terms and Conditions is declared null, illegal, or unenforceable by a competent court, the remaining provisions shall maintain their full force and effect, and the affected provision shall be interpreted as far as possible in accordance with the intention of the parties.

40. Waiver.

The failure of Easy as™ to require strict compliance with any of these clauses shall not constitute or be interpreted as a waiver of its rights to require it in the future.
